Novellia’s Consumer Health Data Privacy Notice

Novellia, Inc. (“Novellia”, “Company” or “We”) is committed to respecting your privacy. Although our Privacy Policy (https://novellia.com/privacy) describes how we handle your personal data generally, this supplemental Consumer Health Data Privacy Notice (“Privacy Notice”) explains our practices around collecting, using and disclosing “consumer health data” subject to Washington’s My Health My Data Act, Nevada’s Consumer Health Data Privacy Law, and other applicable health privacy laws in the United States, as each are amended and as and when they become effective, including any regulations under those laws (“CHD Privacy Laws”).
This Privacy Notice only applies to such consumer health data subject to CHD Privacy Laws, which is a subset of personal information that is generally defined under CHD Privacy Laws as any data that is linked or reasonably linkable to a specific individual and that identifies that individual’s past, present, or future physical or mental health status (“consumer health data”). We provide examples of consumer health data below. Consumer health data does not include information generated by your interactions with us, such as browsing our Website, that does not identify your health status, nor does it apply to publicly available information or personal information that has been deidentified. To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.
Please read this Privacy Notice carefully to understand our policies and practices regarding your consumer health data and how we will treat it. If we make any material updates to this Privacy Notice, we will notify you to the extent required by CHD Privacy Laws. Novellia reserves the right to amend this Privacy Notice at our discretion and at any time.
Consumer Health Data We May Collect About You
Novellia collects, uses and discloses different types of consumer health data as needed to provide you with the products or services that you request or with your consent, which may include:
Information about your health-related conditions, symptoms, diseases, status, diagnoses, testing, or treatments (including surgeries, procedures, medications, or other social, psychological, behavioral, or medical interventions);
Information about your reproductive health or sexual well-being, such as information about your periods or pregnancy status, or about gender-affirming care;
Measurements of bodily functions, symptoms, vital signs, or characteristics, including photographs, which may also be considered biometric information under the CHD Privacy Laws;

Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies;
Information that could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your health; and
Other information that may be used to infer or derive data related to the above or other health information.
Consumer Health Data Sources
As described further in the “Notice at Collection: Information We Collect About You and How We Collect It” section of our Privacy Policy, we collect Personal Information (which may include consumer health data) directly from you, from your interactions with our products and services, from third parties, and from publicly available sources.
Why We Collect and Use Consumer Health Data
We collect and use consumer health data for the purposes described in the “How We Use Your Information” section of our Privacy Policy. Primarily, we collect and use consumer health data as reasonably necessary to provide you with the products or services you have requested or authorized. This may include delivering the products and services, ensuring the secure and reliable operation of the systems that support them, troubleshooting and improving the products and services, and other essential business operations that support the provision of our products and services (such as complying with our legal obligations, developing our workforce, and conducting research and development).
We may also use consumer health data for other purposes for which we give you choices and/or obtain your consent as required by law – for example, for advertising or marketing purposes or to assist our business partners in conducting healthcare research regarding the effectiveness of medical treatments and the discovery of new treatments. See the “Your Privacy Rights” section of the Privacy Policy for more details on the controls and choices you may have with respect to Consumer Health Data.
Our Sharing of Consumer Health Data
We may share each of the categories of consumer health data described above for the purposes detailed in the “Disclosure of Your Information” section of the Privacy Policy. In particular, we may share Personal Information, including consumer health data, with your consent as directed by you, or as reasonably necessary to complete any transaction or provide any product or service you have requested or authorized, as described above.
For example, we may disclose personal information in connection with business transfers (such as part of a merger) or for the protection of Novellia or others. We may also employ or contract with individuals and other companies to perform functions on our behalf. These service providers may have access to consumer health data needed to perform their functions, but may not use it for other purposes. Some of these service providers may be affiliates of Novellia. Novellia only sells your consumer health data if you give us your written permission to do so.
Your Privacy Rights related to Consumer Health Data
If you are covered by CHD Privacy Laws then you may have certain rights with respect to consumer health data, including rights to access, delete, or withdraw consent relating to such data, subject to certain exceptions. You can request to exercise such rights using the various tools and mechanisms described in the “Your Privacy Rights” section of our Privacy Policy.
